Terms of service

Last updated November 1, 2026

This document is a template and needs review by a qualified lawyer before use. It sets out in plain English how [Company legal name] (“Amplifical”, “we”, “us”), of [Registered address], works with brands and agencies that use our services. Please don’t rely on it as a final agreement until that review is done.

About these terms

These terms apply when a business (“you”) uses our website or buys our services. Those services include short-form video and photo content from vetted creators, post-production such as subtitles, resizing and hook variations, and creator and influencer campaigns.

By posting a brief, accepting a quote or paying an invoice, you agree to these terms. If you’re accepting for a company, you confirm that you have the authority to bind it. If you’re an agency acting for a client, you’re responsible for your client’s compliance with these terms as well as your own.

Our services are for businesses, so these terms don’t cover consumer purchases. Creators work with us under a separate creator agreement.

How a project works

  1. You post a brief describing the content you need.
  2. Vetted creators apply, and you choose who you want to work with.
  3. We confirm the scope, price, delivery estimate and usage rights in an order. An order can be a written quote, a proposal or an online checkout.
  4. You send any products to the creators at your own cost, in time for them to film.
  5. Creators produce the content, and we deliver it for your review.

Finished content typically arrives in about 7 to 10 days. That’s an estimate and we can’t guarantee it. It can slip if products arrive late, a brief changes or feedback takes longer than planned. If an order and these terms disagree, the order wins.

Your responsibilities

You’re responsible for what you ask us and our creators to say. In particular, you agree that:

  • Your briefs and product information are accurate, and you can back up any claim you ask a creator to make.
  • Your products are safe, and lawful to sell and advertise wherever you plan to run the content.
  • You have the rights to any logos, music, footage or other materials you give us.
  • You’ll check content before you publish it, including claims, pricing and any required advertising disclosures.
  • You’ll follow the rules of each platform you advertise on and the advertising laws of each market you run in.
  • You won’t ask creators to do anything unsafe, misleading, discriminatory or unlawful, or to say they’ve used a product when they haven’t.

Fees, payment and cancellation

Prices are set out in each order and exclude taxes unless the order says otherwise. Payment is due in full before work begins, unless the order sets a different schedule.

If a payment is late, we may pause work and hold back delivery until it’s settled. Usage rights only begin once we’ve been paid in full.

You can cancel an order before creators start work, and we’ll refund what you’ve paid minus any costs we’ve already incurred. Once filming has started, fees for the work already done remain payable. Content is made to order, so we don’t normally give refunds after delivery. If we can’t deliver what the order describes, we’ll redo the work or refund the affected part.

Revisions and approval

Revisions are included, and each order states how many rounds you get. A revision is a change within the original brief, such as fixing a mistake, trimming a section or re-recording a line.

Changes that go beyond the brief count as new work, which we’ll quote for separately. Examples include a new angle, a new script, a different product or a different creator.

Please send feedback within 7 days of delivery. If we haven’t heard from you by then, we may treat the content as approved.

Usage rights and ownership

Each order says how you can use the content: which channels, which countries, for how long, and whether it covers paid ads, whitelisting or raw footage. Once we’ve been paid in full, you get a non-exclusive licence to use the finished content within those limits. Unless the order says otherwise, ownership of the content stays with the creator or with us.

If you want to use content beyond what the order allows, ask us first so we can arrange a longer or wider licence. When a licence ends, you must stop running the content in paid placements and stop using it in new posts. Organic posts published during the term can stay up unless the order says otherwise.

You may not use a creator’s image, voice or likeness to train an AI model, or to make a synthetic version of them, without that creator’s written consent.

You keep all rights in your brand, products and materials, and you allow us and the creators to use them for the project. We may show finished work in our portfolio unless you tell us in writing not to.

Creators

Creators are independent contractors. They are not employees of Amplifical or of your business. We vet them before they join our network, but we can’t promise that a particular creator will be available, and we may suggest a replacement if someone drops out.

If you want to hire a creator you met through us for new paid work within 12 months of your last project together, you agree to arrange that work through us.

Performance and liability

We’ll provide our services with reasonable care and skill. Advertising results depend on many things outside our control, so we don’t guarantee any particular sales, return on ad spend or other performance.

Nothing in these terms limits any liability that can’t legally be limited. Apart from that, our total liability for a project is limited to the fees you paid for that project, and neither of us is liable to the other for indirect or consequential loss, including lost profits or wasted ad spend.

You agree to cover our reasonable losses if a third party brings a claim because of your products, your materials or claims you asked a creator to make.

Ending an order, changes and contact

Either of us may end an order by written notice if the other seriously breaches these terms and doesn’t fix the problem within 14 days. Licences you’ve already paid for continue after that, within their original limits.

We each agree to keep the other’s non-public business information confidential, including unreleased products and pricing.

We may update these terms from time to time. When we do, we’ll change the date at the top of this page, and the new version will apply to orders placed after that date.

These terms are governed by the laws of the country where [Company legal name] is registered, and the courts of that country have jurisdiction over any dispute.
